In March of 2012, the Florida Senate passed a new personal injury law that has had a profound effect on victims of accidents and the medical care that can be covered under personal injury claim settlements.
Personal Injury Protection (PIP) (HB 119) favors insurance companies by placing limitations on the amount of personal injury benefits that can be awarded, and how financial restitution can be paid out in an accident claim.
This change was made as a result of increased insurance premiums and has placed an additional burden on Florida accident victims.
The new law requires individuals who are injured in an accident to seek medical care within two weeks (14 days) from the date of the accident. Medical care must be administered by approved practitioners, including:
- General practitioners
- Physician’s assistants
- Registered nurse practitioners
Most notably, the list of approved practitioners leaves out chiropractors, acupuncturists and massage therapists:
- Chiropractic care can still be obtained with a referral from a physician, but is limited to $2,500 in treatments.
- Acupuncture and massage therapy are not covered within the new PIP law, and any treatment performed by these practitioners is considered the financial responsibility of the patient.
With many accident injuries, it takes time for the injuries to fully manifest and become symptomatic.
